General Terms and Conditions of Sale

The following General Terms and Conditions of Sale govern the offer and sale of products and services through the website www.ebikelab.it (hereinafter, "Site"). The products and services purchased on this Site (hereinafter, "Products") are sold by Como Expert S.r.l. (hereinafter, "EbikeLab"), with registered office and operational headquarters in Via Lecco 77, Como, registered in the Como Business Register REA CO-811387, VAT number 03372160139. The trademarks, logos, and other distinctive signs present on the Site are the property of their respective owners. It is forbidden to use these distinctive signs without authorization, including their reproduction on other websites. All contents of the Site (including texts, images, graphics, and animations) are protected by copyright and cannot be reproduced or published without the written consent of EbikeLab.

Each purchase of Products through the Site is governed by the following General Terms and Conditions of Sale.

Scope of Application and Conclusion of the Contract

The sale of Products on the Site is considered a distance contract, governed by Legislative Decree 6 September 2005, no. 206, and subsequent amendments, which constitute the "Consumer Code", and by Legislative Decree 9 April 2003, no. 70, relating to electronic commerce.

The purchase of Products on the Site is only allowed to persons who are 18 years old at the time of the order. By purchasing, the Customer confirms that they are of legal age. Otherwise, EbikeLab will not accept the order.

"Customer" means anyone who makes a purchase on the Site, accepting these General Terms and Conditions of Sale.

Before completing the purchase, the Customer must carefully read the General Terms and Conditions of Sale and accept them by selecting the appropriate box. The purchase implies automatic acceptance of these conditions, including those referred to via link. The General Terms and Conditions of Sale are available in the “Terms and Conditions” section of the Site and can be stored or printed.

The Customer is required to verify the correctness of the data reported in the order confirmation email and to promptly report any errors to EbikeLab.

The applicable General Terms and Conditions of Sale are those in force at the time of sending the order. EbikeLab reserves the right to modify them at any time; changes will take effect upon publication on the Site. The Customer is invited to check the updated Conditions before placing a new order.

Purchases on the Site

To purchase Products on the Site, registration is required. Purchases can be made by both consumers and non-consumer customers.

According to art. 3, paragraph 1, letter a) of the Consumer Code, a “consumer” is a natural person who purchases for purposes not related to a professional activity. Entering the VAT number during the purchase indicates the purchase for professional or commercial purposes.

EbikeLab is an online retailer that builds its offer not only based on products available in stock but also based on the availability communicated by suppliers.

Information for the Conclusion of the Contract

In accordance with Legislative Decree 9 April 2003, no. 70, customers are informed that:

To purchase one or more Products on the Site, the Customer must fill out an electronic order form following the instructions. Before sending it, the Customer must accept the General Terms and Conditions of Sale. After completing the order, EbikeLab will send a confirmation email, containing a summary of the General Terms and Conditions of Sale, the characteristics of the purchased product, the price, the payment method, the delivery costs, and any additional costs.

The order form will be stored in EbikeLab's database for the time necessary to execute the order and in compliance with current regulations. The Customer can access their order through their personal area.

Product Availability

The availability and estimated delivery times of each product are indicated on the product page.

The Site is constantly updated to reflect the availability of Products.

However, it may happen that a product ordered is not available at the time of the order due to simultaneous purchases.

In this case, EbikeLab will notify the Customer within 10 working days. The Customer can choose an alternative product or terminate the contract, receiving a refund of the amount paid.

Additionally, EbikeLab regularly checks prices on the Site but cannot guarantee the absence of errors. In case of a price error, the Customer will be offered the option to confirm the purchase at the correct price or cancel it.

Product Information

Each product is accompanied by a Technical Data Sheet with the main characteristics, based on data provided by the manufacturer.

EbikeLab strives to ensure that the images of the products on the Site are as representative of reality as possible. However, colors may vary due to the settings of the devices used by customers. Images may differ in size or details, but the descriptions in the order form will prevail.

In case of supply delays, the manufacturer may replace components with others of equivalent or superior quality. Manufacturers reserve the right to modify product specifications based on component availability during production.

Usage Limitations

The Products sold by EbikeLab have not been tested for military, aeronautical, competitive, or professional applications. EbikeLab disclaims any liability for any damages or malfunctions resulting from use in such contexts.

The usage methods of the products, particularly those related to safety, are indicated in the technical data sheets of the individual items, unless otherwise specified.

Prices

The prices indicated on the Site are expressed in Euros and include VAT (for products sold in Italy). Additionally, where applicable, prices also include the WEEE contribution. Delivery costs, which vary depending on the shipping method, location, quantity, and payment method, will be visible on the product page and in the order summary, as well as in the order confirmation email.

EbikeLab reserves the right to change prices at any time. However, the price applied to the Customer will be the one indicated on the Site at the time of the order, regardless of any subsequent changes. If a price is accompanied by the “List Price”, it means the price recommended by the manufacturer for public distribution.

Purchase Orders

The order confirmation email will contain a "Customer Order Number", which must be used in all future communications with EbikeLab. The order summary will be included in the confirmation, and the Customer must verify its correctness. Any corrections must be promptly communicated through the Online Customer Service, accessible in the "Contact Us" section of the site.

The Customer can monitor the status of the order by accessing their personal area in the "Your Orders" section of the Site.

EbikeLab reserves the right not to accept or cancel orders, particularly in the case of customers with poor creditworthiness, incomplete or incorrect orders, or unavailable products. In these cases, EbikeLab will inform the Customer within 48 hours (excluding Saturdays and holidays) from the receipt of the order. If the order has already been paid, EbikeLab will provide a full refund, according to the methods communicated by the Customer.

Complaints

Any complaints must be sent to Como Expert S.r.l. - Via Lecco 77, 22100 Como (CO), or through the Online Customer Service in the "Contact Us" section of the Site.

Competent Court

These General Terms and Conditions of Sale are governed by Italian law and subject to Italian jurisdiction. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. For disputes relating to the validity, execution, or interpretation of these Conditions, the competent court will be: a) the court of the place of residence or domicile of the Customer, if the latter is a consumer residing or domiciled in Italy; b) exclusively, the Court of Como in all other cases.
